These Shipping and Delivery Terms supplement VAN TOL's Terms and Conditions. The information displayed on the relevant product page and in the checkout also applies.
1. Delivery area
1.1 VAN TOL currently delivers to addresses within the European Union where the relevant destination country or region is selectable in the checkout at vantol.ch.
1.2 Deliveries to Switzerland, the United Kingdom, the United States of America or other countries outside the European Union will only be offered once the relevant destination market has been expressly enabled in the shop. Separate shipping, tax, customs and return conditions may apply to such deliveries.
1.3 If a delivery address cannot be selected in the checkout, delivery to that address is not currently offered.
2. Shipping costs
2.1 Standard shipping to delivery addresses within the currently enabled EU delivery area is free of charge.
2.2 If additional shipping methods, in particular express or special delivery services, are offered in the future, any additional costs will be clearly displayed in the checkout before the order is placed.
2.3 VAN TOL does not charge subsequent standard shipping costs that were not shown to the customer before the order was placed.
3. Delivery time
3.1 Unless a different delivery time is stated on the relevant product page, the regular delivery time is 10 to 20 working days.
3.2 Working days for the purposes of these terms are Monday to Friday, excluding public holidays at VAN TOL's place of business in Freiburg im Breisgau.
3.3 The delivery period generally begins on the first working day after conclusion of the contract and successful payment authorisation, or after receipt of payment if the selected payment method provides for later receipt of payment.
3.4 Where a different delivery time is stated on a product page, that stated delivery time applies. This may apply in particular to particularly complex products expressly identified as special orders.
3.5 If the customer orders several goods with different delivery times and they are shipped together, the delivery time is generally determined by the item with the longest stated delivery time unless a partial delivery is agreed or made.
4. Made-to-order products and product configurations
4.1 Part of the VAN TOL range is manufactured after receipt of the order or assembled in accordance with the regular product options selected by the customer. The regular delivery time of 10 to 20 working days already takes this process into account unless otherwise stated on the product page.
4.2 Describing a product as made-to-order does not automatically mean that the statutory right of withdrawal is excluded. The right of withdrawal is governed solely by the statutory requirements and our information on the right of withdrawal.
4.3 Different delivery times may apply to individually engraved goods or other goods expressly identified as customer-specific special orders. These will be shown to the customer before the order is placed.
5. Shipping and delivery
5.1 VAN TOL selects the shipping service provider taking into account the destination country, shipping method and value of the goods. Where shipment tracking is available, the relevant information will be provided electronically after dispatch.
5.2 The customer is responsible for providing a complete and accurate delivery address during the ordering process. If the customer notices an error in the delivery address after placing the order, they should contact VAN TOL immediately at info@vantol.ch.
5.3 If an address change is no longer possible after the shipment has been handed over to the shipping service provider, further delivery options are governed by the shipping service provider's terms. The customer's statutory rights remain unaffected.
6. Partial deliveries
6.1 VAN TOL may make partial deliveries where this is reasonable for the customer. A partial delivery initiated by VAN TOL will not result in additional standard shipping costs for the customer.
7. Delivery delays and unavailability
7.1 If a confirmed delivery is expected to be materially delayed, VAN TOL will inform the customer using the contact details provided with the order as soon as the delay becomes known.
7.2 The customer's mandatory statutory rights in the event of delivery delay remain unaffected. In particular, any statutory rights to set an additional period for performance, withdraw from the contract or claim damages are not restricted by these terms.
7.3 If it exceptionally becomes apparent after conclusion of the contract that ordered goods cannot be permanently sourced or manufactured, VAN TOL will inform the customer without undue delay. Payments already received for the unavailable goods will be refunded without undue delay using the original payment method. Further statutory rights remain unaffected.
8. Passing of risk for consumers
8.1 For consumers, VAN TOL generally bears the risk of accidental loss of or accidental damage to the goods until the customer or a third party designated by the customer, other than the carrier, takes possession of the goods. Mandatory statutory exceptions remain unaffected.
9. Transport damage
9.1 Where possible, please inspect the shipment after receipt for visible transport damage. If damage is found, we ask you to contact info@vantol.ch promptly and, where possible, provide photographs of the packaging and goods.
9.2 Reporting transport damage to VAN TOL or the carrier is not a condition for a consumer's statutory rights in respect of defects.
